I. Our Commitment to Privacy

This website located at www.cfpnet.com (the “Website”) is maintained by the California FAIR Plan Association (“CFP” or “we” or “us”). We respect the privacy of your information. By using our Website, you consent to the collection and use of this information in the manner described below. The Privacy Policies described below first cover information from people who merely visit our website (“Visitors”), and then continue with respect to the information of people who become applicants and perhaps policyholders of the CFP (“Applicants/Policyholders”).

These Privacy Policies became effective on the date stated at the beginning of these Policies. Any changes to our Privacy Policies will be communicated through our Website at least 30 days in advance of its effective date. Information collected before changes are made will be secured according to the previous Privacy Policies.

II. Visitors

CFP does not collect personal information (that is, information from which an individual may be identified) from Visitors to the Website, other than that information sent via e-mail by Visitors to CFP using the e-mail address in the “contact us” information on the Website (“CFP E-mail Exchange”). CFP uses the information submitted via the CFP E-mail Exchange to respond to a Visitor’s inquiry. CFP will not use the information submitted to the CFP E-mail Exchange, nor share it with any third party, for marketing purposes unrelated to CFP insurance transactions.

CFP may store the information you submit via the CFP E-mail Exchange for such period of time as may be necessary, in its discretion, to resolve a Visitor’s inquiry.

Statistical information derived from the information submitted via the CFP E-mail Exchange may be shared with third parties; however, such statistical information is not associated with any individual in a personally identifiable manner.

As a Visitor, you may browse the Website to access information about CFP products and services, without telling us who you are or revealing any personal information. The only data we collect and store during normal website usage is typical web server log data. Examples of this type of data are: the name of your Internet service provider, the site that referred you to us, any pages you request, and the time and date of those requests etc.

We use this information to generate statistics and measure site activity to benefit Website users. This same information may be shared with third parties in order to provide these services or to analyze, store, or aggregate the information. It may also be shared with other third parties, working with us to improve the services of CFP or the Website.

Collection of Personally Identifiable Information

There may be instances where CFP may request personally identifiable information to provide Website Visitors with a service. This information, such as name, mailing address, e-mail address, and type of request, is collected and stored in a manner appropriate to the nature of the request, as determined by CFP, to fulfill your needs. To reiterate, all information you provide is used to improve the products and services offered by CFP. This information may also be provided to your insurance broker, if any, if you have authorized him/her to act for you in insurance transactions with us. However, it is never provided or sold to any other company for that company's independent use.

Cookies and Other Tracking Devices

We may use cookies and other tracking devices on our Website. Using cookies on our Website provides benefits to you, such as allowing you to maintain your account login information between visits, or locating a nearby dealer. The use of cookies also allows us to measure site activity to provide a better user experience. Cookies and other tracking devices may be used to tell us the time and length of your visit, the pages you look at on our site, the site you visited just before coming to ours, and the name of your Internet service provider.

Please note that when you link to any other website from this Website, the operator of such other website (whether CFP or a third party) may collect information about you, including through cookies or other technologies. Notwithstanding the policies stated above, the right to store and disclose to third parties any information under the following circumstances is reserved: when the law permits it (such as, for example, to comply with laws or to respond to governmental authorities); to legal advisors; and to protect the rights, property, safety or security of CFP, Website visitors or the public.

These Privacy Policies apply solely to online information collection and use practices in connection with this Website; it does not apply to any practices conducted offline or in connection with any other websites owned or operated by CFP.

Information Security

CFP recognizes the importance of safeguarding consumer personal information in CFP's possession from theft, inappropriate use, or improper distribution. It should, however, be recognized that no company can perfectly protect personal information.

III. Applicants/Policyholders

Over the Website, we accept applications for insurance and endorsements from California licensed insurance agents and brokers (to whom we sometimes refer as “Brokers”). In transacting insurance with us, each Broker acts as the legal agent of the applicant or Policyholder. The Broker therefore must have the authorization of the applicant or Policyholder to deal with us over the Internet, and is responsible for obtaining that authorization after the applicant or Policyholder has had an opportunity to review these Privacy Policies. As soon as an application is submitted, the policies described above for Visitors no longer apply (other than as referenced below), and instead each Applicant’s (and Broker ’s) information is governed by the policies stated below.

The Information We Collect

The policies stated above for Visitors under the heading, “Cookies and Other Tracking Devices” applies to Applicants/Policyholders as well.

When a Broker applies for a policy of insurance on behalf of an Applicant, or endorsements on behalf of a Policyholder, all of the information contained in that application becomes subject to these Privacy Policies. The applicant information we collect is categorized as follows:

We need this information to provide and manage the insurance products and services that you request and to let you know of additional goods and services about which you might be interested.

We may also share some or all of the information we collect about you with third parties from one or more of the following categories.

We may ask you for personally-identifying information at other times, such as communicate with us, or complete a survey.

In addition, we automatically gather general statistical information about our Website and visitors, such as IP addresses, browsers, pages viewed, number of visitors, goods and services purchased, etc., but in doing so we do not reference you by individual name, e-mail address, home address, or telephone number. We use this data in the aggregate to determine how much our customers use parts of our site so we can improve our site. We may provide this statistical information to third parties, but when we do so we do not provide personally-identifying information without your permission, unless required by law or as part of our investigation of possible use of our System in violation of our Terms & Conditions. We may match user information we collect with offline data available from other sources in order to carry out our services and conduct target advertising and promotions more effectively.

As part of our services, we use cookies to store and sometimes track information about you. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. Generally, we use cookies to remind us who you are and to enable us to access your account information so you do not have to re-enter it; gather statistical information about usage by registered or unregistered users, research visiting patterns, and help target information based on user interests. Preference and options configurations in your browser determine if and how a cookie will be accepted. You can change those configurations on your computer if you desire. The Way We Use Information

We use information that you provide to us in deciding whether to issue an insurance policy, how much premium to charge for that policy, and in investigations of the validity and extent of loss claims, and whether others persons or organizations (including, as one example, other insurance companies) have any responsibility for losses. In doing that we may combine the information you provide us with information from other sources, and in doing so we share that information with those other sources. These include, for example, credit reporting agencies, investigators, insurance adjusters, and attorneys who are involved in the functions described above.

We may use your personally-identifying information to improve our efforts to sell insurance (for example, to determine whether people who occupy your property or other properties are candidates for other insurance we provide), to statistically analyze site usage, to improve our content and product offerings and to customize our site's content, layout, and services.

We may use your information to deliver information to you that, in some cases, is targeted to your interests. We may ask you to provide us voluntarily with additional information regarding your personal or business interests, experience or requests, which we may use in our service to you.

We use your e-mail address, your mailing address, and phone number to contact you regarding administrative notices, new product offerings and communications relevant to your use of the site.

If you place a request for insurance products or services, we use information to fulfill your order. We sometimes collect additional information, including billing information, credit card number and expiration date, and tracking information from checks or money orders.

We may also use or disclose information to resolve disputes, investigate problems, or enforce our Agreement. At times, we may review the status or activity of multiple users to do so. We may disclose or access information whenever we believe in good faith that the law so requires or if we otherwise consider it necessary to do so to maintain service and improve our products and services.

We use your IP address to help diagnose problems with our server, to manage our Website and to enhance our site based on the usage pattern data we receive.

Security

We employ reasonable and current security methods to prevent unauthorized access, maintain data accuracy, and ensure correct use of information, as more fully described in the Agreement of which these Privacy Policies are a part.

Your Broker ’s account information and profile are password-protected. We recommend that they not divulge their password to anyone. Our personnel will never ask for a password in an unsolicited phone call or in an unsolicited e-mail.

No data transmission over the Internet or any wireless network can be guaranteed to be perfectly secure. As a result, while we try to protect your personal information, we cannot ensure or guarantee the security of any information you transmit to us, and you do so at your own risk.

How You Can Update, Correct or Delete Your Information

You can access the information that we collect online and maintain through normal updating methods. To update, correct or delete this information, you can contact cfpwebsupport@cfpnet.com. Your account can be deleted or deactivated, but doing so will result in your not being able to access member services.

During the normal course of doing business, we will continue to share your information among our business units, our affiliates and unaffiliated third parties as necessary in order to service your accounts with us.

Transfer of Your Information To Successor Organization

CFP reserves the right to transfer all personally-identifying information in its possession to a successor organization in the event of a reorganization of CFP, statutory or otherwise. Other than to the extent provided by law, the use and disclosure of all transferred personally-identifying information will be subject to these Privacy Policies, or to a new privacy policy if you are given notice of that new privacy policy and are given an opportunity to affirmatively opt-out of it. Personally-identifying information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by a successor organization.
